TERMS & CONDITIONS

1. Proof Approval

The client will review a digital proof (or a proof print, if applicable). Final production starts only after order approval and Final Payment is received. Any changes after approval may increase cost and timeline.

2. Artistic Discretion

Client acknowledges the creative nature of photography. Minor variations in color, crop, or texture may occur due to materials and print processing. These are not defects.

3. Copyright & Usage

The Photographer retains all copyright and licensing rights to the commissioned image. Client receives the right to physically display the purchased print for personal enjoyment only. Reproduction, digital distribution, resale, or commercial usage requires a separate written license. Photo credit is required for public display.

4. Cancellations

If the Client cancels before production begins, the deposit is forfeited. If canceled after production begins, Client is responsible for full payment. If the Photographer must cancel due to an inability to complete the order, the deposit will be refunded, and liability ends there.

5. Risk of Loss & Damage

Responsibility for loss/damage transfers to the Client at shipment or delivery. Damage during shipping must be documented with photos within 7 days of receipt.

6. Warranty for Damage & Defects

Manufacturing defects must be reported within 7 days of receipt of the package. At the Photographer’s discretion, a repair or replacement may be provided. Refunds are not available for defects.

If your order arrives damaged, please get in touch with me within 7 days of print arrival with photos of the damage, and I’ll arrange a replacement, an exchange, or a full/partial refund depending on the extent of the damage.

7. Liability Limitation

Photographer’s liability will never exceed the total amount paid by Client. No indirect or consequential damages are covered.

8. Governing Law

This Agreement will be governed by the laws of the State/Country of Hawaii/USA.

9. Entire Agreement

This Invoice + Terms & Conditions constitutes the entire contract between the Parties. Any changes must be mutually agreed in writing.
